Exact date of when the image was published is unknown, however, it appears it was created before 1999. The image is first known to have been published via the official Iraqi Ba'ath website but may have been published prior.
This work was made by Iraqi citizens in Iraq. Iraq was not a participant in the Berne Convention or any other treaty on copyright with the United States at the time of the work's creation. . Therefore the work is public domain in the U.S. See [1]. The image was published in Iraq after 1 March 1989 and the U.S doesn't share a copyright treaty with Iraq, therefore it is in the Public-Domain in the U.S. The source where the image originated from is the official website of the now defunct Iraqi Ba'ath party, which is based in Iraq. It is the earliest website to have published the image besides Wikipedia, and is the original source.
